Terms & Conditions
Ataraxia Journals GmbH Version: 1.0 · Effective from: October 4, 2026
1. Scope and Parties
1.1 These Terms and Conditions ("Terms") govern all contracts concluded through the online shop at www.ataraxiajournals.com (the "Shop") between you and:
Ataraxia Journals GmbH Am Zopfbach 15, 8804 Au ZH, Switzerland Registered seat: Wädenswil, Canton of Zurich Commercial register no.: CH-020.4.084.765-1 UID: CHE-376.260.003 Managing directors: Carola Isabel Diaz Salgado and Basil David Wunderlin Email: info@ataraxiajournals.com Telephone: +41 79 962 15 22
("Ataraxia Journals", "we", "us", "our").
1.2 These Terms apply in the version in force at the time you place your order. We may amend them at any time for future orders; the amended version does not apply to contracts already concluded.
1.3 Your own general terms and conditions do not apply, even if we do not expressly object to them.
1.4 A "consumer" is a natural person entering into the contract for purposes outside their trade, business or profession. Sections that apply only to consumers, or only to consumers resident in the European Economic Area (EEA), are marked as such.
1.5 We sell to consumers and to businesses. We do not sell to persons under the age of 18. By placing an order you confirm that you are at least 18 years old and have full legal capacity.
2. Products
2.1 Physical products. Journals and related paper goods, shipped from Switzerland. Our journals are printed on Pergraphica Natural Rough 100g paper, made in Austria, certified Cradle to Cradle®, EU Ecolabel, and FSC.
2.2 Digital products. Downloadable PDF files, made available to you via a download link after purchase. Digital products are licensed, not sold (see Section 10).
2.3 Product descriptions, images and colours on the Shop are prepared with care, but minor deviations in colour, paper shade, trim and finish are normal for printed and bound products and do not constitute a defect. Where a product is shown together with props or accessories, these are not included unless expressly stated.
2.4 Bundle products. Where the Shop offers bundles of two or more physical products (including "Shared Summits" and "The Base Camp"), the bundle price applies to the specified combination only. Individual items from a bundle may not be returned separately unless the entire bundle is returned.
3. How a Contract is Concluded
3.1 The presentation of products in the Shop is not a binding offer but an invitation to you to place an order.
3.2 By clicking "Buy now" or "Place order" you make a binding offer to purchase the products in your basket.
3.3 Before you submit your order you can review all entries and correct input errors using the back button and the edit functions in the basket. The technical steps leading to the contract are: adding products to the basket, entering your delivery and billing details, choosing a delivery and payment method, reviewing the order summary, and submitting the order.
3.4 We confirm receipt of your order by email without delay. This acknowledgement does not yet constitute acceptance.
3.5 The contract is concluded when we send you a separate order or dispatch confirmation, or when we despatch the products, whichever is earlier. For digital products, the contract is concluded when we make the download available to you.
3.6 We may decline an order, or accept it only in part, without giving reasons — for example where a product is no longer available, where the order appears to be placed for resale, where there are indications of fraud, or where we cannot deliver to your address. Any payment already made will be refunded in full without delay.
3.7 The contract is concluded in English. We store the contract text and send it to you by email.
4. Prices and Taxes
4.1 Prices are shown in CHF and are per item, including applicable Swiss VAT.
4.2 We currently sell and deliver only to customers located in Switzerland and the Principality of Liechtenstein. We do not currently accept orders with a billing or delivery address outside Switzerland or Liechtenstein, and any such order will be declined or cancelled with a full refund. We plan to extend delivery to other countries in the future; this Section will be updated accordingly before that happens.
4.3 Shipping costs are shown separately before you submit your order. Orders above CHF 100 qualify for free shipping within Switzerland and Liechtenstein.
4.4 Because digital products are currently sold only to customers resident in Switzerland or Liechtenstein, Swiss VAT rules apply.
4.5 Ataraxia Journals GmbH is not currently VAT-registered in Switzerland. Prices shown are final prices. Should VAT registration become applicable, prices will be updated accordingly.
4.6 We may correct obvious pricing errors. Where a price is clearly incorrect and you could reasonably have recognised this, we are not bound by it; we will contact you and you may confirm the order at the corrected price or cancel it free of charge.
4.7 Promotional codes cannot be combined unless stated, have no cash value, and lapse if the underlying order is cancelled or returned.
5. Payment
5.1 The payment methods available to you are shown at checkout. We currently accept credit card (Visa, Mastercard), Apple Pay, and Google Pay, processed via Wix Payments.
5.2 Payment processing is provided through Wix Payments. Depending on the payment method chosen, transactions may be processed by Adyen N.V., Stripe Inc., or their respective affiliates and acquiring banks (each, a "Payment Processor"), acting as independent service providers to Wix. Where you pay by card, the terms of the relevant card network and, where applicable, the Payment Processor's own terms also apply to that payment. We are not a party to those terms and have no influence over them.
5.3 Payment is due when the order is placed. Digital products are only released after payment has been received in full.
5.4 We never receive or store your full card or bank details.
5.5 You may only set off claims against our claims where your counterclaim is undisputed or has been finally determined by a court.
5.6 Ownership of physical products passes to you only once the purchase price has been paid in full.
5.7 Refunds are processed through the same payment method used for your original payment and are subject to that processor's standard processing times, which are outside our control.
6. Delivery
6.1 We currently deliver to Switzerland and Liechtenstein only. We do not deliver to packing stations or poste restante addresses unless stated otherwise.
6.2 Physical products are shipped by Swiss Post or equivalent carriers.
6.3 Shipping costs are shown before you submit your order. Orders above CHF 100 are shipped free of charge.
6.4 Delivery times. We dispatch in-stock items within 3 working days of the contract being concluded. Typical transit times are 3–4 working days within Switzerland. These are estimates and not guaranteed dates unless we have expressly agreed a fixed delivery date in writing.
6.5 We may make partial deliveries where reasonable; you will not incur additional shipping costs as a result.
6.6 Please check your order on receipt and report visible transport damage to us at info@ataraxiajournals.com without delay, ideally with photographs. This does not affect your statutory rights but helps us pursue a claim against the carrier.
6.7 Passing of risk. Where you are a consumer, the risk of loss or damage passes to you when you or a third party designated by you (other than the carrier) takes physical possession of the products. Where you are a business, the risk passes when we hand the products over to the carrier.
6.8 If a consignment is returned to us because the address you provided was incomplete or incorrect, or because it was not collected, we may charge you the actual costs of the return shipment before redespatching.
7. Digital Products: Availability and Access
7.1 After payment we make the files available to you as a download via a link in your order confirmation email. Download links are valid for 30 days and may be used up to 3 times. If a link expires before you have downloaded the file, please contact us at info@ataraxiajournals.com and we will reissue it.
7.2 Digital products are supplied as PDF files, optimised for iPad and tablet use. It is your responsibility to ensure that your device and software can open PDF files, and to store them safely after download.
7.3 Digital products are supplied in the version available at the time of purchase. We are not obliged to provide updates unless the product is expressly described as including them.
7.4 Non-refundable once accessed. Because digital products are made available to you immediately and in full upon download, they are non-refundable once the download link has been accessed, except where the file is defective (see Section 12.5). By proceeding to download, you expressly acknowledge and agree to this condition.
8. Returns and Withdrawal — Consumers Resident in Switzerland
8.1 Swiss law does not provide for a general right of withdrawal for contracts concluded online. A statutory right of withdrawal exists only for doorstep and comparable transactions and for contracts concluded by telephone (Art. 40a ff. of the Swiss Code of Obligations), which do not apply to purchases made in the Shop.
8.2 Voluntary returns policy for physical products. As a gesture of goodwill, we accept returns of unused and undamaged physical products within 14 days of delivery. To initiate a return, please contact us at info@ataraxiajournals.com within this period. Return shipping costs are borne by you unless the product is defective. We will process your refund within 14 days of receiving the returned product in satisfactory condition.
8.3 Products that show signs of use, writing, marking, or damage caused after delivery are not eligible for return under this voluntary policy.
8.4 Digital products are non-refundable once the download link has been accessed (see Section 7.4). If you have not yet accessed the download and wish to cancel, please contact us immediately at info@ataraxiajournals.com.
9. Withdrawal Rights — Consumers Resident in the EEA
9.1 If you are a consumer resident in the European Economic Area, you have the right to withdraw from the contract within 14 days without giving any reason.
9.2 The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the goods.
9.3 To exercise your right of withdrawal, you must inform us of your decision by an unequivocal statement sent to info@ataraxiajournals.com before the withdrawal period has expired.
9.4 Effect of withdrawal. We will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days after we receive the returned goods or evidence that you have sent them back, whichever is earlier. We will use the same means of payment as you used for the initial transaction.
9.5 Exception for digital products. By purchasing a digital product, you expressly consent to the immediate supply of the digital content and acknowledge that you lose your right of withdrawal once the download has commenced. This information is provided to you at checkout before you complete your purchase.
10. Intellectual Property and Licence
10.1 All content in the Shop and in our products — including texts, photographs, graphics, layouts, logos, journal narratives, coaching tools, prompts, visualisation exercises, and the names "Ataraxia Journals" and "The Way to the Summit" — is protected by copyright and other intellectual property rights and belongs to us or our licensors.
10.2 When you purchase a digital product we grant you a non-exclusive, non-transferable, non-sublicensable licence to use the file for your own private, non-commercial purposes. You may print it for your own personal use.
10.3 You may not: resell, share, distribute, publish or upload the file; make it available to third parties; use it commercially, including in client work or as part of a paid offering; modify it and distribute the modified version; or remove any copyright notice or protective measure.
10.4 Extended or commercial licences — for example for coaches or therapists wishing to use our materials with clients — are available on request at info@ataraxiajournals.com and are governed by separate licence terms.
10.5 Breach of this Section entitles us to terminate the licence immediately and claim damages.
11. Reviews and User Content
11.1 Where the Shop allows you to submit reviews, comments or images ("User Content"), you must not submit content that is unlawful, offensive, misleading or infringes the rights of third parties. You must have the rights necessary to submit it.
11.2 By submitting User Content you grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, adapt and display it in connection with the Shop and our marketing, for as long as is reasonable for those purposes.
11.3 We may refuse, shorten or remove User Content, in particular where it is unlawful or does not meet our community standards.
12. Defects and Warranty
12.1 Physical products. We warrant that products are free from defects that materially impair their value or fitness for the intended use. Please report defects to us in writing at info@ataraxiajournals.com, with a description and photographs, promptly after you discover them.
12.2 Where you are a consumer, you have the statutory rights in respect of defective goods. Under Swiss law the limitation period is two years from delivery (Art. 210 CO). Where you are a consumer resident in the EEA, the statutory conformity rules of your country of residence apply, providing for a liability period of at least two years from delivery.
12.3 Where a defect is established, we will at our discretion repair the product, supply a replacement, or refund the purchase price against return of the product. Where repair or replacement is impossible, disproportionate or fails, you may reduce the price or rescind the contract.
12.4 Where you are a business, you must inspect the goods immediately on receipt and notify us of any defect in writing within 5 working days; hidden defects must be notified immediately upon discovery. The warranty period for business customers is 12 months from delivery.
12.5 Digital products. We warrant that files are free from defects that materially impair their intended use and correspond to the product description. Defects are remedied by supplying a corrected file. If we cannot do so within a reasonable period, you may rescind the contract and receive a full refund. We do not warrant that files are compatible with every device, software version or paper size.
13. Liability
13.1 We are liable without limitation for damage caused intentionally or through gross negligence, for personal injury, and wherever mandatory law provides for liability that cannot be excluded.
13.2 In all other cases our liability is limited to the foreseeable damage typical of this kind of contract, and in any event to the total amount you paid for the order concerned.
13.3 Liability for indirect and consequential damage, loss of profit and loss of data is excluded to the extent permitted by law.
13.4 Our journals are companions and self-development tools. They are not a substitute for professional medical, therapeutic, psychological or coaching advice. Nothing in our products constitutes medical or clinical guidance. We are not liable for any decisions you make based on the content of our journals.
13.5 Nothing in these Terms limits the statutory rights of consumers that cannot be limited or excluded under the law applicable to them.
14. Data Protection
We process personal data in accordance with our Privacy Policy, available at www.ataraxiajournals.com/privacy-policy. The Privacy Policy forms part of the information we provide to you but is not a contractual term.
15. Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural events, epidemics, war, strikes, transport disruption, failures of energy or communication networks, and official measures. Where such an event lasts longer than 30 days, either party may rescind the contract in respect of the affected performance; payments already made will be refunded.
16. Complaints and Dispute Resolution
16.1 Please contact us first at info@ataraxiajournals.com. We aim to respond to complaints within 5 working days and to resolve them amicably.
16.2 We are not obliged and are not willing to participate in dispute resolution proceedings before a consumer arbitration body. The European Online Dispute Resolution platform was discontinued on 20 July 2025. Consumers in the EEA can find competent national dispute resolution bodies through the European Commission's consumer redress pages.
16.3 Consumers in Switzerland can obtain advice from the Swiss Foundation for Consumer Protection (Stiftung für Konsumentenschutz) or the corresponding cantonal bodies.
17. Applicable Law and Jurisdiction
17.1 These Terms and all contracts concluded under them are governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and excluding conflict-of-law rules.
17.2 Where you are a consumer resident in the EEA, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence.
17.3 The place of jurisdiction is Wädenswil, Switzerland. This applies without restriction where you are a business. Where you are a consumer, the statutory places of jurisdiction remain available to you. Consumers resident in the EEA may in any event bring proceedings in the courts of their place of residence.
18. Final Provisions
18.1 Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions is unaffected. The invalid provision is replaced by the statutory rule that comes closest to its commercial purpose.
18.2 We may transfer our rights and obligations under a contract to a third party, provided this does not disadvantage you. You may transfer yours only with our prior written consent.
18.3 Amendments and supplements to a concluded contract require text form.
